Skilled worker / Work experience

Poštovani gospodine Milorade,

pre svega želim da pohvalim vaš rad (ne samo na ovom sajtu) koji je zaista od pomoći. Hvala na tome!

Da li je moguće da dobijem bodove koji se odnose na radno iskustvo van Kanade, na osnovu projekta koji radim par godina na fakultetu kao PhD student? Nemam staž u radnoj knjižici i plaćen sam preko stipendije Ministarstva. Angažovan sam full-time na projektu (dovoljan broj sati nedeljno) i mogu da dobijem potvrdu rukovodioca o tome (to se poklapa sa mojim obrazovanjem), što bi moglo i da posluži kao preporuka poslodavca (mada je i to pitanje da li bi priznali, jer je rukovodioc projekta - profesor, a ne poslodavac). Mogu da dobijem izvod iz banke o uplaćivanim stipendijama, ali ne i potvrdu o plaćenom porezu državi, jer kao stipendista nisam na taj način prijavljen. Inače, sa Ministarstvom imam ugovor da ne mogu da zasnujem radni odnos (sa nekom firmom) za vreme stipendiranja. Razmišljam kako bi bilo da samo priložim preporuku i izvod iz banke.
To je varijanta koju bih probao bez obezbeđenog poslodavca u Kanadi i dovoljno mi je da priznaju i jednu godinu radnog iskustva da imam preko 70 bodova. Znam da je bolje sa poslodavcem, ali mislim da ga nije lako naći (ako uspem nešto po tom pitanju, možda i sarađujemo za LMO).
Odgovor na ovo moje pitanje nisam uspeo da nađem na internetu, iako sam dosta pretraživao. Jasno mi je da ovo nije vaša specijalnost, ali možda imate neku značajnu informaciju. Ceo proces košta, pa ne bih da uzalud trošim novac i vreme za apliciranje.

Na zalost bojim se da to nece biti moguce, evo zasto:

Ovo je definicija Federal Skilled Worker-a kako pise u zakonu:

Skilled workers

(2) A foreign national is a skilled worker if
(a) within the 10 years before the date on which their application for a permanent resident visa is made, they have accumulated, over a continuous period, at least one year of full-time work experience, or the equivalent in part-time work, in the occupation identified by the foreign national in their application as their primary occupation, other than a restricted occupation, that is listed in Skill Type 0 Management Occupations or Skill Level A or B of the National Occupational Classification matrix;
(b) during that period of employment they performed the actions described in the lead statement for the occupation as set out in the occupational descriptions of the National Occupational Classification;
(c) during that period of employment they performed a substantial number of the main duties of the occupation as set out in the occupational descriptions of the National Occupational Classification, including all of the essential duties;
(d) they have submitted the results of an evaluation — by an organization or institution designated under subsection 74(3) and which must be less than two years old on the date on which their application is made — of their proficiency in either English or French indicating that they have met or exceeded the applicable language proficiency threshold fixed by the Minister under subsection 74(1) for each of the four language skill areas; and
(e) they have submitted one of the following:
(i) their Canadian educational credential, or
(ii) their foreign diploma, certificate or credential and the equivalency assessment, which assessment must be less than five years old on the date on which their application is made.


Kao sto vidite tu pise: "in the occupation identified by the foreign national in their application as their primary occupation," a Vase primarno zanimanje u ovo vrijeme je student i ono sto radite je dio Vaseg programa koji zavrsavate (ako sam ja dobro razumio) i to se u Kanadi zove co-op program i radno izkustvo u Kanadi u co-op programu (sa co-op radnom dozvolom) se ne moze racunati kao radno iskustvo koje je potrebno za CEC ili FSW programu.

Upravo to pise i na CIC web sajtu:

Can I count work experience that was part of my education toward the work requirement?

No. Co-op terms and apprenticeships completed before graduating do not count as skilled work experience. They are considered part of an educational program.
